Unfair Dismissal

Unfair dismissal can apply in any situation where your employment is terminated and you did not resign. This includes redundancy and cases where you feel you were set up to fail. Please see also our section on Appeals.

The way the company went about ending your employment (the steps they took, letters they sent, meetings held, etc.) is important in these cases – and, of course, whether there was a fair reason to dismiss in the first place.

You normally need 12 months minimum qualifying service, unless there are other issues such as discrimination, health & safety or whistleblowing (reporting a criminal act) involved.
