Constructive Dismissal

Constructive dismissal is when a situation is so bad that the employee is entitled to resign and claim unfair constructive dismissal. It is not enough to show that you were unhappy in your job and decided to move on as soon as possible – even if the new job pays less. Please see also our section on Grievances (tab at top of page).

You normally need 12 months minimum qualifying service, unless there are other issues such as discrimination, health & safety or whistleblowing (reporting a criminal act) involved.
